Under the current legal framework in the United States, the National Labor Relations Board (NLRB) is mandated to call for an election when a petition gets handed in requesting for one. Unions, employees, and employers can hand in this petition (Mayer, 2007). In the case of workers and unions, they can only do this if at least a third of the workers sign off on the petition. For a long time, secret ballot elections have been a source of intense debate in the United States. On the one hand, employers argue that union officials might take advantage of the election campaign to advance their interests, resulting in the employees’ voices getting muzzled. On the other hand, unions argue that employers might use their resources and reach to coerce employees to vote against their unions. Before launching an election campaign, employers have to furnish unions with a list comprising of the names and details of eligible voters (Mayer, 2007). The NLRB is responsible for conducting these elections.
