Robert Steinberg (appellant) applied to the appellee (Chicago Medical School) to gain first-year admission for the 1974-1975 academic year. The appellant also paid the required $15 fee to enter the institution. Steinberg decided to institute a class-action lawsuit against the applicant when the appellant’s admission was turned down. In his suit, the appellant alleged that the institution failed to assess his application and those made by others as per the academic entrance parameters it had published in its bulletin.
