Tort Law

  1. Find an article that describes a situation where a business is currently facing a tort case or seems likely to face a tort case in the future based on a specific incident or practice.
  2. Include either a full copy of the article or a link to where the article is available.  The article must be from a reputable source that you would feel comfortable citing in an academic paper.
  3. Based on the readings and our discussions of tort law, analyze the situation and provide answers to the following questions:
  4. What are the facts that are or may become the basis for a tort claim? (5)
  5. What tort claims are possible in this situation?  Who would sue whom for what? (10)
  6. Suggest one specific policy or practice the company could adopt to prevent or limit liability in this type of case. (10 pts.)

Employment Law

  1. Find an advertisement for a job opening, preferably from the company’s own website.
  2. Include a full copy of the advertisement with a note indicating where it was found.
  3. The employment reading assignment (also posted on Canvas) highlights a number of laws and practices related to employment discrimination.  Using those concepts, analyze the advertisement. Provide specific answers to the following questions:
  4. Is the advertisement written to appeal to a diverse group of potential employees? If so, provide specific examples.  If not, provide specific suggestions about how it could be modified to do so. (10 pts.)
  5. In your opinion, are the qualifications required for the position legitimately necessary for a person to perform the work that is described?  If so, explain the connection between the job and the qualification.  If not, explain why you believe the qualification is unnecessary or unrelated. (10 pts.)
  6. Based on the advertisement, would you pursue a job with the company if one was available that matched your interests and qualifications?  Why or Why not? (5 pts.)
